1. Scope, Acceptance & Apple Standard EULA

PhotoFlexi (the "App") is distributed through Apple’s App Store and is licensed, not sold. Apple’s Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary licence agreement for the App. These Supplemental Terms describe App-specific functionality, privacy practices, and responsibilities and supplement, rather than replace, the Apple Standard EULA.

By downloading, installing, purchasing, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory rights granted by applicable law always prevail over any conflicting provision.

2. Developer & Contact Identity

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). Public seller and trader information applicable to your territory is also displayed by Apple on the App Store product page.

3. App Functionality & Platform

PhotoFlexi is a photo-editing application for the supported Apple devices shown on its current App Store listing. It lets users select images, segment subjects, remove or change backgrounds, apply the other editing and processing operations presented in the App, preview results, and save or export edited images using available system destinations.

Available tools, input formats, export formats, device compatibility, and minimum operating-system requirements are those shown in the current App Store listing and the installed App. Results may vary with the source image, resolution, device resources, storage, colour profile, and export format.

4. Licence & Permitted Use

Subject to the Apple Standard EULA and these Supplemental Terms, the included licence permits personal and professional use of the App. You retain your rights in the photos you import and the edited files you create, subject to any rights attached to the source material.

Except where applicable law expressly permits otherwise, you may not copy, redistribute, rent, sublicense, reverse-engineer, decompile, disassemble, bypass protection, extract proprietary assets, or use the App or its components to create a competing product.

5. App Store Distribution, Payments & Refunds

Apple handles App distribution and, where applicable, price, taxes, payment details, purchase entitlements, Family Sharing or other Usage Rules, and refund requests. The Developer does not receive your payment-card details. The current App Store listing states whether a price, in-app purchase, subscription, or trial is offered; these Terms do not create or promise any payment option or trial not shown there. Mandatory refund and consumer rights remain unaffected.

6. App Privacy — Local Photo Processing

The Developer operates no account system or backend server for the App. Photos selected for editing and resulting previews or exports are processed locally on the device and are not uploaded to the Developer. The App contains no Developer-operated advertising, behavioural tracking, analytics, or telemetry.

The App accesses only the photos, files, or export locations that you choose or authorise through Apple’s system interfaces. You can review or revoke photo access in device Settings. Content may leave the device only when you deliberately save it to a synchronised location, use a system share destination, or send it through another service you select; those services apply their own privacy terms.

7. Local Storage, Exports & Deletion

The App or the operating system may temporarily hold image data, previews, edit state, or caches while an operation is in progress. Saved photos and exports remain in the location you choose until you delete them. Removing the App may remove App-local data but does not necessarily delete files already saved to Photos, Files, cloud storage, or another destination.

8. Apple Services & Diagnostics

Apple may process App Store transactions, installations, crash reports, and optional diagnostics under the user’s Apple privacy and diagnostics settings. Apple may provide developers with aggregated analytics or diagnostic reports. The App does not add its own tracking to that Apple-controlled process.

9. Support & Website Information

Sorin Nae is the data controller for personal information voluntarily submitted through support channels or the Software Evolution website contact form.

If you contact us, we receive the information you choose to provide, such as your name, email address, message, App version, device details, or sample files you deliberately attach. We use it only to respond, provide support, prevent abuse, comply with legal obligations, or establish and defend legal claims. The legal basis is performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations where applicable.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Those providers may process form and technical connection data under their own policies. Do not send private photographs, passwords, payment-card details, or unnecessary sensitive information through support channels.

Support correspondence is retained only as long as reasonably necessary to answer the request, maintain support and security records, meet legal obligations, or resolve disputes, and is then deleted or anonymised where appropriate.

10. Your Data-Protection Rights

Because App photos remain on your device, the Developer normally has no server-side copy to access or delete. For personal information voluntarily provided through support, applicable law may give you rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to [email protected]. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

11. Your Photos & Required Rights

You retain ownership of photos and other content you select. Selecting content authorises the App to process it for the operation you request; it does not transfer ownership to the Developer. You are responsible for having the rights and permissions needed to edit, reproduce, publish, distribute, or otherwise use third-party images, likenesses, trademarks, or other protected material.

12. Editing Results, Originals & Backups

Image adjustments, subject segmentation, background removal, generated masks, and exports are computational operations and may produce incomplete or inaccurate contours, missing hair or fine detail, retained background areas, unexpected crops, colour shifts, compression, artifacts, metadata changes, or loss of detail. Keep the original image and an independent backup, use a copy for important work, and inspect the full-resolution output before printing, publishing, delivering, or deleting source material.

13. Intellectual Property & Trademarks

The App, source code, interface, documentation, and proprietary assets are protected by intellectual-property law and are owned by or licensed to the Developer, except for clearly identified third-party components and rights. Apple and other third-party names and trademarks remain the property of their respective owners and are used only for identification. No affiliation or endorsement is implied.

14. Warranties & Mandatory Consumer Rights

The Apple Standard EULA contains the warranty terms applicable to the App. To the maximum extent permitted by law, the App is provided "as is" and "as available", and the Developer does not promise error-free operation, a particular artistic result, or compatibility with every image or future system.

15. Limitation of Liability

Nothing in these Terms excludes liability for fraud, intentional misconduct, or any injury, damage, remedy, or responsibility that applicable law does not allow to be excluded or limited.

Subject to that rule and to the maximum extent permitted by law, the Developer is not liable for indirect or consequential loss, third-party service failure, or avoidable loss of photos or edit work where a reasonable independent backup and review process was not maintained. Nothing here reduces a protection provided by the Apple Standard EULA or mandatory consumer law.

16. Updates, Availability & Termination

Features, supported formats, minimum system versions, and interface details may change as the App evolves. Required updates will be provided as required by applicable law. Your licence may terminate if you materially breach the Apple Standard EULA or these Supplemental Terms, subject to applicable law. Termination does not transfer ownership of your photos or edited files to the Developer.

17. Changes, Governing Law & Disputes

We may update these Terms to reflect functionality, legal requirements, security needs, or business changes. Material changes will be communicated by reasonable means and will not retroactively remove a purchased entitlement or mandatory consumer right. Where consent is legally required, a change takes effect only after valid consent.

These Supplemental Terms are governed by Romanian law, without depriving consumers of mandatory protections or courts available under the law of their country of habitual residence. Please contact us first so we can attempt to resolve a concern.
