MixCrop — Audio Cropping Tool for macOS

Short version: MixCrop loads, displays, crops, and exports audio locally on your Mac. Sorin Nae operates no user account or app backend for the App and does not receive your source audio, selected ranges, waveforms, or exported files. Core playback, waveform, selection, and export functions work offline. Apple separately processes Mac App Store acquisition, updates, and related account or diagnostic information.

1. Scope, Acceptance & Apple Standard EULA

MixCrop (the "App") is distributed through the Mac App Store and is licensed, not sold. Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary license agreement for the App. These Supplemental Terms describe App-specific functionality, privacy practices, and responsibilities and supplement, rather than replace, the Apple Standard EULA.

By downloading, installing, acquiring, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory rights granted by applicable law always prevail over any conflicting provision.

2. Developer & Controller Identity

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). For personal information voluntarily sent through support, Sorin Nae is the controller.

3. App Functionality & Compatibility

MixCrop is a macOS audio-cropping tool for loading audio, displaying a waveform, defining precise time ranges, previewing playback, and exporting selected segments. The product page identifies support for common formats including MP3, WAV, M4A, AIFF, and FLAC, with M4A export, themes, and playback controls.

Actual import and export availability depends on the App version, source encoding, and system media capabilities. Current device, operating-system, language, and regional compatibility is shown on the Mac App Store product page.

4. Licence & Permitted Professional Use

Subject to the Apple Standard EULA and these Supplemental Terms, the included licence permits personal and professional use of the App on devices you own or control, as permitted by Apple's Usage Rules. You remain responsible for the rights and obligations applicable to the audio you process and the files you create.

Except where applicable law or an applicable third-party licence expressly permits otherwise, you may not copy, modify, sublicense, sell, rent, redistribute, reverse-engineer, decompile, disassemble, bypass protection, remove proprietary notices, or attempt to derive the App's source code or proprietary components.

5. Mac App Store Acquisition, Payments & Refunds

Apple controls Mac App Store availability, territorial distribution, price, taxes, payment processing, account association, redownloads, and refunds. The Developer does not receive your payment-card details. Any purchase or refund is subject to Apple's terms and applicable mandatory consumer law.

6. App Privacy — No Developer Backend or Tracking

The Developer operates no account system or backend server for MixCrop. The App does not upload your source audio, selected ranges, waveform information, or exported segments to the Developer.

The App contains no advertising network, third-party analytics SDK, behavioral tracking, or Developer-operated telemetry. Audio loading, waveform generation, preview, cropping, and export are performed locally on your Mac.

7. Information Processed & Stored Locally

To provide its functions, the App may locally read or create source-audio references, decoded audio, waveform information, playback state, selected time ranges, temporary working files, exported segments, theme choices, and other preferences. Source and output files remain in locations you select or authorize.

8. Apple Services, App Store Analytics & Diagnostics

Apple may process acquisition, installation, update, sales, crash, and optional diagnostic information under your Apple privacy and diagnostics settings. These Apple-controlled processes are governed by Apple's Privacy Policy. MixCrop does not add its own analytics or tracking to that process.

9. Support & Website Information

If you contact us by email or through the contact form on the Software Evolution website, we receive the information you voluntarily provide, such as your name, email address, message, App version, device details, or diagnostic material you choose to attach. We use it only to answer your request, provide support, prevent abuse, comply with legal obligations, or establish and defend legal claims. The applicable legal basis may be performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Those providers may process form and technical connection data under their own policies and applicable data-processing terms. Do not send passwords, payment-card details, copyrighted source audio, or unnecessary sensitive information through support channels.

Support correspondence is retained only for as long as reasonably necessary to answer the request, maintain support and security records, meet legal obligations, or resolve disputes, and is then deleted or anonymized where appropriate.

10. Your Data-Protection Rights

Because source and exported audio remain on your Mac, the Developer normally has no server-side copy to access or delete. For personal information voluntarily provided through support, applicable law may give you rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to [email protected]. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

11. Your Audio & Required Rights

You retain ownership of audio files you select and segments you export, subject to any third-party rights in the source material. Selecting a file authorizes the App to process it locally for the operation you request; it does not transfer ownership to the Developer.

You are responsible for having all permissions and licences required to copy, edit, reproduce, distribute, publish, or otherwise use source and exported audio. The App and its acquisition do not include rights to third-party music, recordings, podcasts, broadcasts, or other protected material.

12. Cropping, Timing & Export Results

Waveform display, playback position, selected boundaries, and encoded export are technical representations that may be affected by file encoding, sample timing, variable bitrate, metadata, and system media behavior. Preview and verify every exported segment before deleting source material, publishing it, or relying on it for a performance or delivery.

13. Files, Temporary Data & Backups

Keep independent backups of irreplaceable source files and important exports. Interrupted writes, insufficient storage, permissions, disk faults, external editors, cloud-sync tools, or selecting an unintended destination can cause failure or inconsistency. Temporary working files may be removed automatically, but operating-system temporary data may be managed independently by macOS.

14. Format & Metadata Compatibility

Import, preview, and export depend on container format, codec, channel layout, sample rate, metadata, copy protection, file integrity, and system capabilities. A listed file extension does not guarantee that every encoding variant will be accepted or produce identical output. Re-encoding may change audio characteristics or metadata.

15. System Conditions & Professional Use

Processing speed and reliability can be affected by file duration, available storage, memory, system load, thermal conditions, operating-system behavior, and third-party storage. Test the workflow and exported file before time-critical or professional use.

16. Intellectual Property & Trademarks

The App, source code, interface, original documentation, and original assets are owned by or licensed to the Developer and are protected by intellectual-property law. Third-party and open-source components remain subject to their respective owners' rights and licence terms. Apple and all other product or brand names are trademarks of their respective owners and are used only for identification.

17. Warranties & Mandatory Consumer Rights

The Apple Standard EULA contains the warranty terms applicable to the App. To the maximum extent permitted by law, MixCrop is provided "as is" and "as available", and the Developer does not promise error-free or uninterrupted operation, compatibility with every file, or a particular creative or technical result.

Nothing in these Supplemental Terms excludes, restricts, or replaces rights that cannot legally be waived. Consumers in Romania and the European Union retain mandatory rights concerning conformity, required updates, repair or bringing into conformity, proportionate price reduction, termination, refund, and other remedies, including rights under Romanian OUG 141/2021 and applicable EU law.

18. Limitation of Liability

Nothing in these Terms excludes liability for fraud, intentional misconduct, or any injury, damage, remedy, or responsibility that applicable law does not allow to be excluded or limited.

Subject to that rule and to the maximum extent permitted by law, the Developer is not liable for indirect or consequential loss, lost revenue, reputational loss, failure to obtain content licences, third-party storage or service failure, or avoidable loss of source or exported data where a reasonable independent backup was not maintained. This section does not replace the Apple Standard EULA or reduce any mandatory consumer remedy.

19. Updates & Availability

We may provide maintenance, security, compatibility, and feature updates. Required consumer updates will be provided as required by applicable law. Other features, supported formats, devices, and compatibility details may change as the App evolves. Apple controls continued Mac App Store availability.

20. Changes to These Terms

We may update these Terms to reflect new features, legal requirements, security needs, or operational changes. The revision date will be displayed above, and material changes will be communicated by reasonable means such as the website, App Store release notes, or an in-App notice in a future version. Where law requires consent rather than notice, a change will take effect only after valid consent.

21. Suspension & Termination

Your licence may terminate if you materially breach the Apple Standard EULA or these Supplemental Terms, subject to applicable law. Termination does not transfer ownership of your source or exported audio to the Developer. Provisions concerning intellectual property, user responsibility, privacy, liability, and dispute resolution survive where their nature requires it.

22. Governing Law & Disputes

These Supplemental Terms are governed by Romanian law, without excluding applicable conflict-of-law rules. If you are a consumer, this choice does not deprive you of mandatory protections or courts available under the law of your country of habitual residence. Before formal action, please contact us so we can attempt to resolve the issue. Consumers may also contact the competent consumer-protection authority or European Consumer Centre.
