Supplemental Terms of Use & Privacy Policy

1. Scope & Apple Standard EULA

Klumbo (the "App") is distributed through the Mac App Store and is licensed, not sold. Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary licence agreement. These Supplemental Terms describe App-specific functionality, credits, privacy, and responsibilities and do not replace it.

By downloading, installing, purchasing credits, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory legal rights always prevail over a conflicting provision.

2. Developer & System Requirement

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). Klumbo requires a compatible Apple Silicon Mac. Current operating-system and compatibility information is displayed on the App Store product page.

3. App Functionality

Klumbo is a local image editor offering multi-layer composition, background removal, repair, enhancement, upscaling, crop, resize, erase and fill tools, filters, transformations, text layers, shadows, reflections, and related editing controls. Features and available output limits may vary by App version, source image, memory, storage, and Mac configuration.

Automated results are estimates. Edges, reconstructed areas, colors, textures, faces, text, fine details, and enlarged content may be inaccurate or synthetic-looking. Review every result before printing, publishing, archiving, or delivering it to a client.

4. Credits

Importing an image into the editor consumes one credit. This applies to the first image and to every additional image imported as a layer. For example, one base image plus two imported image layers consumes three credits. After an image has been imported, editing operations applied to that image do not consume additional credits unless the App clearly states otherwise before the action.

Eligible new users currently receive 10 complimentary credits. The available purchased credit packages may change over time. The App Store purchase sheet is authoritative for the package size, quantity, regional price, taxes, and availability shown before purchase.

A credit is deducted when an image import is accepted by the editor.
Removing, undoing, closing, or replacing an imported image does not automatically restore the credit.
Credits have no cash value and cannot be sold, transferred, or exchanged.
The credit balance and processed-transaction records are stored locally on the Mac using system-protected storage. They are not transferred between Macs or Apple Accounts.
Unused credits do not expire while the local secure record remains available. The record normally survives an ordinary App update and may survive reinstallation on the same Mac, but it is not a guaranteed backup. Erasing or replacing the Mac, clearing Keychain or App data, storage failure, or system changes may remove access to the balance.
Package contents and prices may change for future purchases; an ordinary price change does not remove an existing local balance.

5. Purchases, Restore & Refunds

Apple processes credit purchases, regional prices, taxes, payment details, and refund requests. The Developer does not receive payment-card details or Apple Account credentials. Consumable credits are not a subscription and are not restored from completed StoreKit purchase history. Klumbo can check for a verified transaction whose delivery was interrupted, but this does not restore already delivered and consumed credit packs.

Refund requests are processed by Apple through reportaproblem.apple.com. A credit already consumed by an import is not automatically returned by removing the image. These rules do not limit mandatory refund, conformity, or consumer rights.

6. App Privacy and Local Processing

The Developer operates no Klumbo account system or App backend. The App does not upload your images, layers, edits, output files, file paths, or credit balance to the Developer and contains no Developer-operated advertising, behavioral tracking, or analytics service. Image processing and saving are performed locally on your Mac.

The balance and transaction-delivery record remain in local system-protected storage. To prevent repeated complimentary-credit grants, Klumbo may place a minimal trial-eligibility marker in the local Keychain and request synchronization of that marker through iCloud Keychain when the user has enabled that Apple service. The marker contains no image, edit, payment-card detail, or credit balance, and the Developer does not receive it.

An internet connection may be required to load StoreKit products, purchase credits, check pending transaction delivery, or let Apple synchronize the trial-eligibility marker. Apple may process App Store, purchase, iCloud Keychain, installation, crash, or optional diagnostic information under the user's settings and Apple's Privacy Policy. Apple may provide developers with aggregated analytics or diagnostic reports; the App does not add its own tracking to that Apple-controlled process.

7. File Access, Saving & Backups

The App accesses images and folders selected or authorized by the user. Images are loaded for editing and saved to a location chosen by the user. The source file is not intentionally modified unless the user chooses the same location and confirms replacement or overwrite.

Keep backups of original images and verify saved output before closing a project, deleting source material, publishing, printing, or delivery. File permissions, insufficient storage or memory, unsupported formats, interrupted saves, external editors, cloud synchronization, or system failure may cause incomplete or unavailable output.

8. Your Images and Required Rights

You retain ownership of images and content selected for editing. You are responsible for having permission to access, edit, transform, combine, reproduce, save, publish, or commercially use every image, logo, font, likeness, trademark, and other element. The App does not grant rights in third-party material or guarantee that an output is unique, non-infringing, accurate, or suitable for a regulated or evidentiary purpose.

9. Licence and Intellectual Property

Subject to the Apple Standard EULA, you may use the App for personal or commercial image editing. Except where applicable law or a component's applicable licence expressly permits otherwise, you may not copy, modify, rent, sublicense, redistribute, reverse-engineer, decompile, disassemble, bypass the credit system or technical protection, extract proprietary assets, automate the App to avoid credit use, or use the App unlawfully.

The App, source code, interface, documentation, processing implementation, and proprietary assets are protected by intellectual-property law and are owned by or licensed to the Developer, except for clearly identified third-party rights. Applicable third-party notices and licences remain controlling for the components they cover.

10. Third-Party Licences

Klumbo uses Core ML models derived from the following open-source projects. Each component remains subject to its respective copyright notice and licence. Nothing in these Supplemental Terms restricts rights granted by those licences.

The App includes the complete applicable Apache 2.0 and BSD 3-Clause licence texts, copyright notices, conditions, and disclaimers in its bundled legal resources. The Core ML conversion does not replace or restrict the licences governing the underlying models and weights.

11. Support and Website Privacy

Sorin Nae is the data controller for personal information submitted through support channels or the Software Evolution website contact form. If you contact us, we receive information you voluntarily provide, such as your name, email address, message, App version, device details, or diagnostic files. Do not attach private images, client material, passwords, payment-card details, or unnecessary sensitive information.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Support information is used to answer requests, maintain security records, comply with legal obligations, or establish and defend legal claims, and is retained only as long as reasonably necessary for those purposes. The applicable legal bases are performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations where applicable. Further website processing is described in the Website Privacy Policy.

12. Data-Protection Rights

The Developer normally has no server-side copy of images processed only inside the App. For information voluntarily submitted through support, applicable law may provide rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to [email protected]. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

13. Warranties, Liability & Consumer Rights

The Apple Standard EULA contains the warranty and liability terms applicable to the App. To the maximum extent permitted by law, the App is provided "as is" and "as available" without a promise of uninterrupted operation, perfect edits, a particular artistic result, recoverable credits, or compatibility with every image and system configuration.

Nothing in these Supplemental Terms excludes liability or any conformity, update, repair, price-reduction, termination, refund, or other right that applicable law does not allow to be excluded. Nothing reduces a protection or remedy provided by the Apple Standard EULA or mandatory consumer law.

14. Updates and Changes

The App and these Terms may be updated for maintenance, security, compatibility, functionality, credit offerings, or legal reasons. Material changes will be communicated by reasonable means. Changes do not retroactively remove a purchased local credit balance or mandatory consumer right. Where law requires consent, a change takes effect only after valid consent.

15. Governing Law

These Supplemental Terms are governed by Romanian law, without excluding applicable conflict-of-law rules. Consumers retain mandatory protections and courts available under the law of their country of habitual residence.
