Deletion warning: Duplicate detection is an estimate, and files selected for removal are moved to the macOS Trash. Verify each result and keep an independent backup before removing anything.

1. Scope & Apple Standard EULA

Duplicate Clean (the "App") is distributed through the Mac App Store and is licensed, not sold. Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary licence agreement. These Supplemental Terms describe App-specific functionality, privacy, and responsibilities and do not replace it.

By downloading, installing, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory legal rights always prevail over a conflicting provision.

2. Developer

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). Questions may be sent to [email protected].

3. App Functionality

The App scans folders selected by the user, reads file names, duration, file size, format, and folder location, and uses those characteristics to group probable duplicates. It estimates recoverable space and provides local playback and Finder access to help the user decide which copy to keep.

Duplicate detection is not proof that two files are interchangeable. Different masters, edits, bit rates, metadata, cue points, artwork, loudness, channel layouts, or file integrity can matter even when audio appears similar. The App does not guarantee that it will find every duplicate or avoid every false match.

4. App Store Purchase & Refunds

Apple handles App distribution, regional price, taxes, payment details, bundles, Family Sharing or other Usage Rules, and refund requests. The Developer does not receive your payment-card details or Apple Account credentials. The current App Store purchase sheet is authoritative for the price and availability shown before acquisition. Mandatory refund and consumer rights remain unaffected.

5. File Access, Trash & User Decisions

The App accesses files and folders the user selects or authorizes. For each probable group, the largest file is presented as a suggested keeper and the remaining files as review copies; this is a convenience heuristic, not a determination of originality or quality. Individual removal acts on the file selected by the user, while the bulk cleanup action moves all displayed review copies to the macOS Trash. Trash contents may later be emptied manually or automatically by macOS, after which recovery may be difficult or impossible.

Before removal, use playback and Finder information to verify the exact path, format, metadata, quality, and version. Do not scan or remove system files, application resources, active project files, or the only copy of irreplaceable material.

6. App Privacy and Local Processing

The Developer operates no Duplicate Clean account system or App backend. The App does not upload your audio files, folder contents, file paths, comparison attributes, scan results, or deletion choices to the Developer and contains no Developer-operated advertising, behavioral tracking, or analytics service. Scanning, comparison, and playback are performed locally on your Mac.

Local preferences may remain on the Mac after a session. Apple may process App Store, installation, crash, or optional diagnostic information under the user's settings and Apple's Privacy Policy. Apple may provide developers with aggregated analytics or diagnostic reports; the App does not add its own tracking to that Apple-controlled process.

7. Backups and Recovery

Maintain an independent backup before scanning or removing files. The Trash is not a backup. The Developer cannot restore files that have been deleted, overwritten, lost through storage failure, removed from Trash, or changed by other software or synchronization services.

8. Your Audio and Required Rights

You retain ownership of files selected for scanning. You are responsible for having permission to access, play, compare, move, and delete them and for complying with copyright, client, workplace, library, storage, and backup obligations. Selecting a folder authorizes local processing for the requested function and does not transfer ownership to the Developer.

9. Licence and Intellectual Property

Subject to the Apple Standard EULA, you may use the App for personal or business music-library organization. Except where applicable law expressly permits otherwise, you may not copy, modify, rent, sublicense, redistribute, reverse-engineer, decompile, disassemble, bypass protection, extract proprietary assets, or use the App unlawfully.

The App, source code, interface, documentation, comparison implementation, and proprietary assets are protected by intellectual-property law and are owned by or licensed to the Developer, except for clearly identified third-party rights.

10. Support and Website Privacy

Sorin Nae is the data controller for personal information submitted through support channels or the Software Evolution website contact form. If you contact us, we receive information you voluntarily provide, such as your name, email address, message, App version, device details, or diagnostic files. Do not attach copyrighted audio, private folder listings, passwords, payment-card details, or unnecessary sensitive information.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Support information is used to answer requests, maintain security records, comply with legal obligations, or establish and defend legal claims, and is retained only as long as reasonably necessary for those purposes. The applicable legal bases are performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations where applicable. 11. Data-Protection Rights

The Developer normally has no server-side copy of files or scan results processed only inside the App. For information voluntarily submitted through support, applicable law may provide rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to [email protected]. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

12. Warranties, Liability & Consumer Rights

The Apple Standard EULA contains the warranty and liability terms applicable to the App. To the maximum extent permitted by law, the App is provided "as is" and "as available" without a promise of perfect detection, uninterrupted operation, recoverability, or compatibility with every file and system configuration.

Nothing in these Supplemental Terms excludes liability or any conformity, update, repair, price-reduction, termination, refund, or other right that applicable law does not allow to be excluded. Nothing reduces a protection or remedy provided by the Apple Standard EULA or mandatory consumer law.

13. Updates, Termination & Changes

The App and these Terms may be updated for maintenance, security, compatibility, functionality, or legal reasons. A licence may terminate following a material breach of the Apple Standard EULA or these Terms, subject to applicable law. Material changes will be communicated by reasonable means, and no change retroactively removes a purchased entitlement or mandatory consumer right.

14. Governing Law

These Supplemental Terms are governed by Romanian law, without excluding applicable conflict-of-law rules. Consumers retain mandatory protections and courts available under the law of their country of habitual residence.
