Important reminder

CarEvidence is an organization and reminder tool only. It does not verify official records, renew documents, pay fees, communicate with authorities, or replace your legal duty to keep vehicles, drivers, insurance, inspections, road-use documents, and other records valid.

1. Scope & Apple Standard EULA

CarEvidence (the "App") is distributed through Apple's App Store and is licensed, not sold. Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") is the primary licence agreement. These Supplemental Terms describe App-specific functionality, privacy, and responsibilities and do not replace it.

By downloading, installing, or using the App, you accept the Apple Standard EULA and, to the extent permitted by law, these Supplemental Terms. Mandatory legal rights always prevail over a conflicting provision.

2. Developer

The App is developed and provided by Sorin Nae ("Developer", "we", or "us"). Questions may be sent to [email protected].

3. App Functionality

The App lets users organize vehicle and driver information, photographs, registration-related documents, insurance, technical inspection and road-use expiry dates, reminder settings, and related notes. It can schedule local notifications and export or import fleet information in a portable file selected by the user.

Information displayed by the App is based on user entries. The App does not obtain or validate data from insurers, vehicle registries, inspection authorities, tax authorities, employers, or government databases.

4. Expiry Dates, Notifications & Legal Compliance

You are responsible for entering and independently verifying every vehicle, driver, document, and expiry date and for completing renewals on time. Notification delivery can be delayed, suppressed, grouped, silenced, or prevented by permissions, Focus modes, device settings, battery state, time-zone changes, system behavior, device failure, or user action.

Do not rely on the App as the only record or reminder. To the maximum extent permitted by law, the Developer does not assume responsibility for fines, penalties, loss of vehicle use, missed renewals, or other consequences caused by inaccurate entries, missed notifications, or failure to verify official requirements.

5. App Store Purchase & Refunds

Apple handles App distribution, regional price, taxes, payment details, Family Sharing or other Usage Rules, and refund requests. The Developer does not receive your payment-card details or Apple Account credentials. The current App Store purchase sheet is authoritative for the price and availability shown before acquisition. Mandatory refund and consumer rights remain unaffected.

6. App Privacy and Local Processing

The Developer operates no CarEvidence account system or App backend. The App does not upload your vehicle records, driver details, photographs, document information, expiry dates, or exported fleet files to the Developer and contains no Developer-operated advertising, behavioral tracking, or analytics service.

Data is processed and stored locally on the device. Apple may include App data in device backups or synchronize system information according to the user's Apple settings; those Apple-controlled processes are governed by Apple's Privacy Policy. Local notification content may be visible on the lock screen depending on device settings.

7. Driver and Other-Person Data

If you enter, import, store, photograph, export, or share information about a driver, employee, family member, vehicle owner, contact, or any other person, you are responsible for having an appropriate legal basis, authority, and permission for that processing. Where applicable, you must give the person the required privacy information, keep the data accurate and secure, limit access and retention, and respond to valid data-protection requests. The App does not make the Developer the controller of records kept only on your device or determine whether your intended fleet use is lawful.

8. Photos, Exported Files & Sharing

The App accesses photographs or files only after the user selects or authorizes them. An exported fleet file may contain personal, vehicle, driver, document, or contact information. Once you save, share, copy, email, back up, or import an exported file, its security and disclosure depend on your choices and the destination service. Review the file and intended recipient before sharing it.

9. Data Ownership, Accuracy & Backups

You retain responsibility for and control of the content you enter or import. Keep independent backups and periodically use the export feature for important fleet records. Device loss, App deletion, damaged storage, failed backups, operating-system changes, incomplete exports, or overwritten imports may make local information unavailable.

10. Licence and Intellectual Property

Subject to the Apple Standard EULA, you may use the App for personal or business fleet organization. Except where applicable law expressly permits otherwise, you may not copy, modify, rent, sublicense, redistribute, reverse-engineer, decompile, disassemble, bypass protection, extract proprietary assets, or use the App unlawfully.

The App, source code, interface, documentation, and proprietary assets are protected by intellectual-property law and are owned by or licensed to the Developer, except for clearly identified third-party rights.

11. Support and Website Privacy

Sorin Nae is the data controller for personal information submitted through support channels or the Software Evolution website contact form. If you contact us, we receive information you voluntarily provide, such as your name, email address, message, App version, device details, or attachments. Do not send vehicle documents, identity documents, driver records, passwords, payment-card details, or unnecessary sensitive information.

The website contact form is processed using Formspree, and the website is delivered through Cloudflare. Support information is used to answer requests, maintain security records, comply with legal obligations, or establish and defend legal claims, and is retained only as long as reasonably necessary for those purposes. The applicable legal bases are performance of a contract or steps requested by you, our legitimate interest in providing secure support, and legal obligations where applicable. 12. Data-Protection Rights

The Developer normally has no server-side copy of information stored only inside the App. For information voluntarily submitted through support, applicable law may provide rights of access, correction, deletion, restriction, objection, portability, and complaint to a supervisory authority. Requests may be sent to [email protected]. Romanian users may also contact the National Supervisory Authority for Personal Data Processing.

13. Warranties, Liability & Consumer Rights

The Apple Standard EULA contains the warranty and liability terms applicable to the App. To the maximum extent permitted by law, the App is provided "as is" and "as available" without a promise of uninterrupted operation, notification delivery, error-free import/export, or compatibility with every future system version.

Nothing in these Supplemental Terms excludes liability or any conformity, update, repair, price-reduction, termination, refund, or other right that applicable law does not allow to be excluded. Nothing reduces a protection or remedy provided by the Apple Standard EULA or mandatory consumer law.

14. Updates and Changes

The App and these Terms may be updated for maintenance, security, functionality, or legal reasons. Material changes will be communicated by reasonable means, and no change retroactively removes a purchased entitlement or mandatory consumer right. Where law requires consent, a change takes effect only after valid consent.

15. Governing Law

These Supplemental Terms are governed by Romanian law, without excluding applicable conflict-of-law rules. Consumers retain mandatory protections and courts available under the law of their country of habitual residence.
